The West African Examinations Council (WAEC) plans to appeal a stay on execution order by an Accra High Court in a case filed by the some students regarding the outfit’s withholding of examination results.
Results of some ten thousand High School students in the West African Secondary School Certificate Examinations (WASSCE) have been withheld by the examination council, WAEC over alleged malpractices and irregularities. The students’ results were not part of those announced on December 30, 2024.
Some affected students responded by filing a case in court against the WAEC. On January 30, 2025, the court delivered a verdict in favour of four students who had filed a petition on behalf of all affected students. According to the court, the WAEC must release the results of the ten thousand students without predjudice, holding that the council’s justification for withholding the results was vague and inconsistent.
Moreover, the decision to withhold the results could affect the academic progression of the students, said the court.
Displeased with the ruling, the WAEC filed a stay-on-execution appeal.
But the appeal was squashed by the court on February 20, 2025, as it cites the WAEC’s lack of sufficient justification for its action. Moreover, the council was fined a sum of GHC5,000.00.
Following this new order, the WAEC has said it will release the results depending on some factors. According to the WAEC’s Head of Legal Affairs, Rev. Victor Brew, the outfit will also repeat the stay of execution application.
“We are going to repeat the stay of execution application at the court of appeal in line with what is established procedure in court matters.
“As for 28th [February], it is for the generality of all outstanding results and just to clarify these are just a portion of all the outstanding results. So even as these 10,000 candidates went to court, we are still working and so 28th is a date to say that all results finally would have been worked on.
“Those that are exonerated, they would have their results uncanceled. Those that will be found culpable will have their results canceled. Perhaps the only group of people will be those students who took us to court, and we have to respect the court procedure,” he said.
