The National Democratic Congress (NDC) has filed a lawsuit to stop the Electoral Commission (EC) from recollating parliamentary results in five constituencies.
The constituencies in question are Dome-Kwabenya, Okaikwei Central, Ablekuma North, Tema Central, and Obuasi East.
Although the 2024 general election has recorded less violence and malpractices compared to the previous one, a few incidents marrring the process has left many questioning some results that have been declared.
Apart from the burning of some alleged fake ballot papers, there have been reports alleging that some EC officials had announce results under duress.
After announcing the NDC candidates winners, the EC later declared result for the Dome-Kwabenya, Okaikwei Central, Ablekuma North, and Tema Central invalid based on some identified irregularities.
But the NDC believes the initial declaration which saw their respective candidates victorious should remain unchanging, as the declaration becomes “functus officio” thereby preventing the EC from re-collating, re-counting or re-declaring the results. The applicants are Faustina Elikplim Akurugu, Baba Sadiq, Ewurabena Aubynn, Ebi Bright, and Samuel Aboagye, all who were initially declared winners in the constituencies they contested.
The NDC is seeking an “order prohibiting the respondent from re-collating, re-counting and re-declaring the already collated and declared parliamentary election results in the Dome-Kwabenya, Okaikwei Central, Ablekuma North, and Tema Central constituencies.”
“A declaration that by virtue of Article 99 of the 1992 constitution of the Republic of Ghana and section 16 of PNDCL 284, it is the High Court of Ghana that has the exclusive original jurisdiction to invalidate the declaration of parliamentary election results and not the respondent.”
The lawsuit is therefore seeking “an order of perpetual injunction restraining the Respondent, its assigns, agents, privies, servants, employees, workmen and any other person acting on its behalf without an order of a court competent jurisdiction from re-collating and re-counting and re-declaring the declared results in the constituencies in contention.”
