A private legal practitioner, Martin Kpebu is calling for the immediate resignation of the Controller and Accountant General, Kwesi Kwaning Bosompem after the latter filed nomination to contest the Akim Swedru seat in the New Patriotic Party’s parliamentary primaries.
Mr. Kpebu’s call adds to the Minority caucus ‘ demand for the resignation of Mr. Bosompem. His remain in office after filing nomination they say is in contradiction with the law.
Citing Article 94(3), Mr. Kpebu stressed that officeholders in the security services such as the Police Service, Military, Prisons as well as persons serving in the Legal service, Judicial service, Civil service and Audit service among others become ineligible for such positions once they seek to contest in primaries.
According to him, the law prohibits their participation in such a political activity.
Mr. Bosompem’s position falls under the civil service, therefore, upon a true interpretation of the law, the Controller and Accountant General ought to resign, the lawyer argued.
“The CLOGSSAG case actually says that if a civil servant becomes overt in his political affiliation, then he has to resign. It is not just about nomination alone. Let me read a part, apart from talking about the nomination, this is what it says;
“Upon a true and proper interpretation of the constitution, a member of the civil service or local government service does not have the right to remain a member of a civil service or local government service after his or her a nomination by the political party or otherwise to contest for election as a Member of Parliament.”
“Moreover such a person shall resign from his or her office, immediately after his or her political activities become overt,” he said.
He stressed that since the Mr. Bosompem has started campaigning, his political activities become overt, therefore, he must vacate his current position.
“He is already campaigning, he has a campaign team, it’s overt. Look, this is beyond redemption. He just has to go,” he concluded.
